Terms and Conditions of membership

These terms and conditions (the “Terms”) are set out to ensure that the “Parties” Platt Lane Sports Complex (“PLSC”) as one party and the (“Member”) being another party understand the conditions of use of the complex Gym and its Facilities. These Terms must be read prior to the Member signing the Agreement. By signing the Agreement, the Member confirms that they have read and understood the terms and is prepared to be bound by them.

Gym Opening Hours

Platt Lane Sports Complex is open between Monday and Friday from 08:00hrs until 22:00hrs and on Saturday and Sunday from 08:00 hrs until 17:00hrs. The opening hours may be subject to change from time to time, and in the event of such changes, PLSC will provide as much notice as is reasonably possible.

Responsibilities of the Member

  1. The member must ensure that all membership subscriptions and fees are up to date or as otherwise agreed in writing with PLSC.  Failure to ensure that membership subscription has been made may result in PLSC terminating your agreement without notice and cancelling your membership.
  2. On taking out a membership with PLSC, the member consents to having their photograph taken to confirm their identity upon entry.
  3. The Member must at all times have available their PLSC membership card for inspection. This membership card is not transferable. PLSC reserves the right to withdraw membership in the event of a breach of provision. Any lost or mislaid cards will be replaced for a nominal fee.
  4. Gym membership for PLSC is only available for 18 year olds and above.
  5. The Member must be responsible for his own conduct and at all times treat all the equipment within the premises with care and respect. Failure to comply with this provision will render the membership terminable immediately.
  6. Whilst on the premises and while using the gym equipment, consideration must be given to other gym and equipment users. It is expected that equipment is wiped down after use and the gym left in a clean and tidy manner. Failure to comply with this provision may result in your membership being cancelled without notice.
  7. Whilst using the Gym equipment, the Member must be dressed in suitable Gym attire. Bare chests will not be tolerated and denim considered unsuitable. No outdoor shoes are permitted in the gym area and training shoes must be worn.
  8. The Gym operates a policy in which it expects all users to maintain high standards of personal hygiene and if you fail to adhere to this policy, you may be asked to leave the gym immediately.
  9. The Member may, for an additional none refundable fee, hire some equipment from PLSC. The equipment must not leave the facility site and be returned after the Hire Period.
  10. Failure to return equipment for any reason may result in your membership being terminated.
  11. Any accident and or damage, howsoever arising, must be reported to PLSC management, and a form detailing the matter, completed and signed by both parties at the time of the incident.
  12. The report shall require both the identification of how the accident or damage occurred and the potential cost of repair or otherwise to ensure that the damage is rectified to the satisfaction of PLSC. If agreement cannot be reached at the time of the incident, PLSC reserve the right to obtain quotes for works or repairs to be carried out as soon as reasonably practicable and thereafter invoice the Member for a full refund. PLSC will pursue any failure to pay for damage as a debt.
  13. You are responsible for your own Health and Safety at all times. If you have any condition that you are aware of which prevents you from undertaking exercise, and you continue to use the gym, you do so entirely at your own risk. If this condition is likely to cause injury to others you may be liable for any such event arising from your negligent conduct.
  14. The Member must ensure that all the premises and facilities are left in a reasonable condition as set out by PLSC. The Member shall ensure that prior to leaving the premises, the gym and facilities used are clear of all rubbish, equipment put away and the area left in a condition fit for use by another patron.  It is good practice to wipe down equipment with a towel after use.
  15. Food and drink, other than water, is not permitted within the training area. Alcohol is prohibited anywhere on site.
  16. All children must be accompanied by a parent or guardian at all times at PLSC. No children are permitted to use the gym equipment or be in the Training area.
  17. PLSC has a priority to be respectful to its neighbours and other local residents. The Member must also adhere to this policy and ensure they arrive and leave the complex in a respectful and dignified manner without causing noise, nuisance, littering or otherwise disturbing the peace (ie no loud music, shouting, or speeding in cars). Failure to comply with this requirement may result in your exclusion from the premises.
  18. PLSC is a NON-SMOKING site. No areas are permitted for smoking and anyone found doing so will be asked to leave.
  19. The use of foul or abusive language and any aggressive or violent behaviour will not be tolerated during the use of the gym or any other activity. Any abusive behaviour or intimidation towards PLSC staff or other user will not be tolerated and a breach of this provision shall result in immediate removal from the site and where necessary the Police being called. 
  20. Photography is not permitted on site without permission from The Management Team. It is strictly prohibited for a Member to use any images or videos of PLSC in a promotional context. The Intellectual Property rights vest entirely with PLSC and failure to comply with this provision could lead to Court proceedings being undertaken. In the event that photographic materials are used for improper purposes PLSC will involve the Police immediately.
  21. Use of any text or imagery such as the MMU logo is not permitted; any use of such material may lead to legal proceedings. Written consent must be acquired from MMU for the use of any branding.
  22. The consumption of food is NOT permitted in areas which are not designated for such at PLSC.
  23. The member is responsible for ensuring the gym facilities are left clear and clean of all bottles , personal belongings etc. Failure to respect complex cleanliness and standards could result in termination of membership.
  24. The premises must be used only for the specific purpose for which the membership is given. Ignoring this rule will result in termination of the membership.

Responsibilities of Platt Lane Complex Management

  1. PLSC reserve all rights in relation to the Facilities and or equipment and have the discretion to refuse admission or expel persons from the facility where the member is in breach of any of the Terms and Conditions.
  2. The Complex or its partners are not liable for any damage or loss to any person or property whatsoever. All visitors leave their cars and belongings here entirely at their own risk.

Payment Policy

  1. Membership fees can be paid in full or monthly by direct debit.
  2. Monthly fees will be debited from your bank account on or around the 1st of each month. In the event that the member falls into arrears in respect of any fees payable, all arrears must be settled before the member can use the club. Other payment methods will be considered via a request to Platt Lane administration team.  
  3. MMU reserves the right to charge an administration fee for any unpaid direct debits.
  4. The member will be committed to a 3 month minimum membership contract (minimum contracted period) before their membership subscription can be terminated. In exceptional circumstances, the complex manager will be the final arbitrator of any request made to cancel the membership within the minimum contract period.

Cancellation policy

  1. A 14 day ‘cooling off’ period is admissible providing none of the gym facilities have been used during this time. PLSC must be notified of your wish to terminate your contract within the 14 days for any refund of fees to be claimed.
  2. Members on a monthly direct debit contract may cancel their membership after the end of the minimum contracted period, by giving one full months advance written notice, effective from the 1st of the following month.
  3. Where payment method is direct debit, the member must advise their bank to cancel the direct debit instruction after the final payment has been made. PLSC is not obliged to refund any fees where the member has not cancelled the instruction in time.
  4. Paid in full memberships will expire automatically at the end of the term. No refunds are applicable for any portion of fees paid upfront.
  5. In exceptional circumstances, the complex manager may waiver this policy.
